Some counties implemented Oregon's electronic filing system later, so the verdicts for those counties may begin in 2015. WHERE DOES THE INFORMATION COME FROM?

The information contained in this page comes from the pleadings filed by the parties to these lawsuits. It is important to know these are allegations. So, if you see a severe injury alleged and a small verdict, it may mean that the jury either did not believe the injury occurred or did not believe it was caused by the defendant. When the plaintiff alleges more than one injury, we try to indicate the primary and secondary injury. When there are numerous serious injuries, we may classify that as a "polytrauma" case.

WHY DOES VERDICT RESEARCH MATTER? 

Verdict research helps lawyers and clients understand what juries have done in similar cases. Past verdicts cannot predict the future, but they do give us information about the field of possibilities. It is important to understand that no two cases are the same. And even if they were, the results might vary considerably. Many factors can affect a jury verdict including the venue, strength of the liability case, injury severity, and the skill of the lawyers involved. Be cautious about placing too much emphasis on this data.

Plaintiff Owens was a mountain biker riding on Defendant’s “cannonball” mountain biking trail when he crashed and suffered severe injuries including paraplegia.  Plaintiff alleged that Defendants were negligent for failing to follow accepted safe design criteria for mountain bike parks, specifically constructing a ditch that was unreasonably dangerous given the speeds defendants knew bikers would reach in the area and placing a sign within the high speed “runout zone” of the trail.  Plaintiff sought $2,700,000.00 for past medical and rehabilitation bills, $5,500,000.00 for future economic damages and $10,000,000.00 for non-economic damages.

Defendants alleged that Plaintiff was an expert level mountain biker who  was familiar with the trail having run it many times, including on the date of the injury.  They alleged that he was negligent and therefore responsible for his own injuries by riding too fast for the trail conditions, riding a bike that was not designed for downhill mountain biking, failing to keep a proper lookout, and failing to abide by Defendants’ instructions and directions.

Verdict was after after 25% reduction for comparative negligence.

Plaintiff was in two rear-end car accidents within a week. He sued both the at-fault drivers and alleged that each caused his need for cervical discectomy and fusion. Prior to trial, Plaintiff settled with the driver from the first crash. He proceeded to trial against the second at-fault driver. The jury found that the settling driver caused 50% of the damage to Plaintiff therefore the verdict was reduced by 50% from $120,087.26 to $60,043.63.

This case involved a DUII crash. The decedent was a passenger in a ranch truck driven by Defendant Enriquez. The truck was owned by Defendant Flynn. The estate of the decedent brought suit against the drunk driver but also the owner for negligently entrusting the vehicle with the drunk driver. The jury found that the owner was not negligent and that the decedent was 50% comparative negligent for riding with the drunk driver. Damages were therefore reduced by 50%.
